Welcome to Fixit! Fixit is a platform owned and operated by FixitGroup LLC (“Company,” “we,” or “our”) that connects users seeking home repair services (“Users”) with independent contractors (“Contractors”). By accessing or using the Fixit app, you agree to be bound by the following Terms of Use and Disclaimer. If you do not agree, do not use the app.

DISCLAIMER

1. Platform Only:
   Fixit is a technology platform providing a venue for Users and Contractors to connect. Fixit does not provide repair services, act as a contractor, or guarantee the performance of any Contractor. Contractors are not employees, agents, or representatives of Fixit.
2. No Guarantees or Warranties:
   Fixit makes no guarantees regarding the:
   • Quality, suitability, legality, reliability, or timeliness of any services provided by Contractors.
   • Accuracy or completeness of any information provided on the app.
     All services are provided “AS IS” without warranties of any kind, express or implied.
3. Independent Transactions:
   Any agreements, terms, or transactions entered into between Users and Contractors are solely between those parties. Fixit is not a party to such agreements and is not responsible for enforcing them.
4. Limited Liability:
   To the fullest extent allowed by law, Fixit and its officers, directors, employees, and affiliates will not be held liable for:
   • Any damages or injuries resulting from the use of the app or services provided by Contractors.
   • Any loss of data, business interruptions, reputational harm, or legal disputes between Users and Contractors.
5. Due Diligence Encouraged:
   Fixit strongly recommends that Users conduct thorough research, including reviewing licenses, certifications, and references before hiring any Contractor.

TERMS OF USE

1. Acceptance of Terms

By using Fixit, you affirm that you are at least 18 years old and legally able to enter into binding contracts. If you do not agree to these terms, you must immediately stop using the app.

2. User Obligations

• Users must provide accurate and truthful information when creating accounts or posting tasks.
• Users are solely responsible for selecting and contracting with Contractors.
• Users agree to release Fixit from any liability arising from Contractor performance or lack thereof.

3. Contractor Obligations

• Contractors are required to comply with all applicable laws, regulations, and licensing requirements.
• Contractors agree to accurately represent their qualifications and services.
• Contractors are solely responsible for taxes, licenses, insurance, and any other legal obligations related to their work.

4. Payment Terms

• Fixit charges Contractors a flat fee of $39.99 for access to the platform.
• Fixit does not handle payments between Users and Contractors. Payment terms, including refunds or disputes, must be resolved directly between the parties involved.

5. No Employee Relationship

Contractors are not employees or agents of Fixit. Nothing in this agreement creates a joint venture, partnership, or employer-employee relationship between Fixit and Contractors.

6. Prohibited Activities

Users and Contractors are prohibited from:

• Engaging in fraudulent, illegal, or misleading activities.
• Posting or sharing defamatory, obscene, or harmful content.
• Attempting to circumvent platform fees or engage in off-platform transactions.

7. Disputes Between Users and Contractors

Fixit will not mediate disputes between Users and Contractors. Both parties are encouraged to resolve disputes amicably or through third-party mediation or legal proceedings, at their own expense.

8. Indemnification

Users and Contractors agree to indemnify and hold Fixit, its affiliates, and its employees harmless from any claims, damages, or legal actions arising out of:

• Misconduct or negligence.
• Breaches of agreements between Users and Contractors.
• Violations of applicable laws or third-party rights.

9. Privacy and Data Use

Fixit collects and uses personal information in accordance with its Privacy Policy. By using the app, you consent to the collection and use of your information as described therein.

10. Intellectual Property

All content, trademarks, logos, and other intellectual property on the Fixit app are owned by FixitGroup LLC. Unauthorized use, reproduction, or distribution is prohibited.

11. Limitation of Liability

To the extent permitted by law, Fixit’s total liability under these Terms will not exceed the amount paid by the User or Contractor to Fixit during the preceding 12 months. Fixit is not liable for indirect, incidental, or punitive damages.

12. Termination of Use

Fixit reserves the right to suspend or terminate any account for violations of these Terms of Use, fraudulent behavior, or misuse of the platform.

13. Modifications to Terms

Fixit reserves the right to modify these terms at any time. Notice of changes will be posted on the app, and continued use after such changes constitutes acceptance.

ARBITRATION AGREEMENT

Any disputes arising from these Terms or use of the Fixit app must be resolved through binding arbitration in [Your State/Region]. Both parties waive the right to a trial by jury or participation in class-action lawsuits.
